Fundraising and Reward Terms & Conditions

1. Anybody can fundraise on behalf of Clean Up Australia Day 2009. But if you would like to take part and volunteer your time on the day, please make sure you register directly with Clean Up Australia. You can register online at htto://events.cleanup.org.au.

2. Information on taking part in fundraising and information on the Clean Up Australia Day fundraising incentive is part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

3. The fundraising incentive is only valid for participants who raise money via the GoFundraise online fundraising system located at www.gofundraise.com.au and raise the highest total funds either as an individual, business, or school. This amount is as shown on their fundraising page ("Raised Total”)

4. The Business that fundraises the most will be presented with the ‘Clean Up Australia Business Fundraiser of the Year’ award. The top site coordinator and top three individual fundraisers will win a trip to Sydney for a day of sailing with Ian Kiernan AO on his yacht Maris. The school that raises the most money for Clean Up will win a trip for six students and a teacher where they will visit the Clean Up Australia offices, have a picnic lunch with Ian Kiernan AO followed by an afternoon at Observatory Hill.

4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity and age) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry. Failure by GoFundraise to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. Promotion commences at 9:00am AEST on 10/02/2009. Entries close at11:59pm AEST on 31/03/2009. Winners will be officially notified on 09/04/2009.

6. In the event of war, terrorism, state of emergency or disaster, GoFundraise reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.

7. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of GoFundraise and Clean Up Australia, GoFundraise and Clean Up Australia reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

8. Except for any liability that cannot be excluded by law, GoFundraise and Clean Up Australia (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of GoFundraise; (d) any variation in prize value to that stated in these Terms and Conditions; or (e) any tax liability incurred by an entrant.

Clean Up Australia Day Terms & Conditions

Persons participating in the 2009 Clean Up Australia Day campaign must agree to the following terms and conditions prior to their registration being accepted by Clean Up Australia Ltd.

If entering online, participants must check the ‘I agree’ box prior to completing the registration process. Postal registrations must be received on the official ‘Site Registration Form’.

Volunteer registrations maybe completed either online prior to the event or on the official 'Volunteer Registration Form" at the respective Site on the day. Participants must sign to acknowledge acceptance of the terms and conditions. An authorised parent or guardian must sign the entry form for children aged under 15 years.

1. I agree that Clean Up Australia Ltd and local event organisers will not be liable for; any injury sustained by the participant; any loss or damage to property owned by, or in the possession of, the participant; any act or omission, negligence of fault of any person participating in the Clean Up.

2. If acting as either a Site Coordinator or Site Supervisor, I certify that I am 18 years of age or older.

3. If volunteer participant is under 15 years of age, I certify that I am the parent / legal guardian and she / he has my consent to participate in the Clean Up activity.

4. I acknowledge and consent to photographs being taken of me during my participation in the Event. I acknowledge that the photographs maybe forwarded to Clean Up Australia Ltd to use the photographs for promotional or other purposes without my further consent.
